The terms for using Tolbrook

What an audit is, and what it is not

An audit records what our automated browser observed on a website’s public pages, from a stated place and on a stated date. It is an observation of how the site behaved during that visit.

It is not legal advice and not a legal opinion, and it does not say whether a website meets any law. Websites change, and a result describes the visit it records. For what applies to your business, talk to your own lawyer.

Asking for an audit

Anyone can ask us to audit a website’s public pages. When you ask, give an email address you control. We may decline or stop any audit, for example to protect a website from too many requests.

How we publish

We follow the process described under How it works on our homepage. The site’s owner always hears from us first. A clean result is published. If we find something, nothing is published for 28 days while the owner puts it right; then we audit again and publish what we observe that day, fixed or not.

Paying for help never changes a report, a re-audit date or what we publish. A published result is a dated record of what we saw. If we got something wrong, we correct it as our independence statement describes.

Paid services

Our services and their prices are listed on the Services page, and card payments are taken by Stripe. Each service has its own rule on cancelling and refunds.

• Full audit fix guide: you can cancel for a full refund until the full report is first opened. We record when that happens. Once it has been opened you have received what you paid for, and the fee is not refundable.
• Weekly monitoring: a 12-month agreement, billed monthly. It renews automatically for another 12 months on each anniversary unless you cancel before that date. Cancelling stops the next renewal; the monthly payments for the current 12 months still fall due.
• Done for you: you can cancel for a full refund until we begin work. We confirm in writing, by email, the day work begins. From then on the fee is not refundable.
• Sector reviews and portfolios: we agree the scope, timing and terms with you in writing before we start.

Using our reports and pages

Our reports, sector papers and the words on this website belong to Tolbrook. You are welcome to quote and share our published results and sector reports, as long as you name Tolbrook, link to the page you are quoting, and do not change what it says or present it as saying something it does not.

The Audited by Tolbrook badge may only be shown on the website it was issued to, linked to that website’s published record.

Fair use of the website

Please do not:

• use the audit to overload a website, or to reach pages that are not public;
• try to get around our request limits, or interfere with how the service runs;
• collect our pages or results in bulk by automated means;
• misrepresent a result, or claim we found something we did not.

No promises beyond these terms

To the extent the law allows, the website and the free audit are provided as they are, without any promise that they suit a particular purpose or will always be available.

Limits on our liability

To the extent the law allows, Tolbrook is not responsible for indirect or consequential losses, such as lost profits or lost business, and our total liability for any claim about a paid service is limited to what you paid us for that service in the twelve months before the claim. Nothing in these terms limits anything that cannot be limited by law.

Changes to these terms

When we change these terms we update the date at the top. Changes apply from that date; a service you have already paid for keeps the terms in place when you bought it until it ends.
